对于前款规定的船舶油污损害赔偿请求，责任保险人或者财务保证人有权以损害是因船舶所有人的故意造成的进行抗辩，并有权援用船舶所有人除破产或者清算之外的理由进行抗辩。
第八十四条 被申请人提出证据证明涉外仲裁裁决有本法第八十三条第一款规定的情形之一的，经人民法院组成合议庭审查核实，裁定不予执行。
